Overview

These Terms of Service govern your use of the Duskwell online store and purchases made through it.

By placing an order, you agree to these terms and the policies presented as part of your purchase, subject to applicable consumer protection laws.

Nothing in these terms excludes or restricts rights that cannot lawfully be excluded or restricted.

Eligibility

You must be legally able to enter into a purchase agreement in your jurisdiction.

You agree to provide accurate contact, billing, and delivery information and to use a payment method you are authorized to use.

Product Information

We aim to describe our products accurately, including their features, included items, prices, and intended use.

Photographs and illustrations may show models, staged environments, or digitally created imagery. Refer to the written product specifications and the description of the selected set for what is included in your order.

Images do not establish medical effectiveness or guarantee a particular experience.

If an item materially differs from its description, contact us. Your applicable consumer rights remain available.

Intended Use and Safety

The Duskwell Wind-Down Band is offered for personal comfort and relaxation.

Use the product only according to the instructions and warnings supplied with it. Remove the band before sleeping. Stop using it if you experience discomfort, irritation, excessive heat, or another unexpected reaction.

The product and accompanying educational content are not substitutes for medical diagnosis or treatment.

Prices and Currency

All prices and order charges are in United States dollars (USD) unless expressly stated otherwise before purchase.

Applicable taxes and any charges collected by Duskwell will be displayed before you complete checkout.

Your bank or payment provider may apply currency conversion rates or fees if your payment account uses another currency. Those charges are determined by the provider.

Prices and promotions may change for future purchases. Changes do not retroactively increase the price of an accepted order.

Orders and Payment

An order confirmation acknowledges receipt of your order. Orders remain subject to payment authorization, product availability, and any verification reasonably necessary to prevent fraud.

If we cannot fulfill an order, we will contact you and refund any payment collected for the unfulfilled items.

If we identify a material pricing or description error affecting your order, we will explain the issue and offer you the choice of proceeding on corrected terms or cancelling for a refund. We will not charge an increased amount without your agreement.

Shipping and Delivery

Shipping is governed by our Shipping Policy and the information provided before purchase.

Delivery estimates are subject to the limitations disclosed at checkout, but do not remove your legal rights when an order is late or not delivered.

Contact us promptly if delivery information needs to be corrected or an order appears lost or damaged.

Returns, Refunds, and Warranty

Our Return and Refund Policy explains the 60-Night Wind-Down Guarantee and the one-year limited product warranty.

These benefits supplement applicable statutory cancellation rights, implied warranties, and consumer guarantees.

We do not exclude applicable product warranties merely by describing the website or its content as informational.

Digital Guides

Digital guides included with an order are provided for your personal, noncommercial use.

You may save and use your copy. You may not resell, publicly distribute, or commercially reproduce the guides without permission, except where permitted by law.

The guides provide general educational information and do not create a healthcare relationship.

Acceptable Use

You must not use the store to:

• Commit fraud or use another person’s payment details without authorization.
• Interfere with the security or operation of the website.
• Introduce malicious code.
• Unlawfully collect personal information.
• Infringe intellectual property or other legal rights.
• Submit unlawful, threatening, or abusive content.

We may restrict misuse of the website where reasonably necessary. Such action does not erase obligations relating to legitimate orders or existing consumer rights.

Intellectual Property

Duskwell branding, original website materials, and other protected content are owned by Duskwell or used with permission.

You may browse and use the store for personal shopping purposes. Other uses remain subject to applicable intellectual property laws.

Reviews and Feedback

Reviews and feedback must reflect genuine experiences and must not contain deceptive or unlawful content.

If you submit a review for publication, you permit us to display it with the public name you provide and to make formatting changes that do not alter its meaning.

We will not condition a remedy or customer-service assistance on submitting a positive review or withdrawing an honest negative review.

Third-Party Services

The store may link to or support services operated by independent providers, including payment services.

Their separate terms may apply to their services. Those terms do not eliminate Duskwell’s responsibilities to you as the seller.

Privacy

Our Privacy Policy describes the handling of personal information connected with the store.

Agreeing to these terms does not substitute for separate consent where privacy or marketing laws require it.

Website Availability and Liability

We take reasonable care in operating the store, but cannot guarantee uninterrupted access or freedom from every technical error.

Nothing in these terms excludes liability that cannot lawfully be excluded, including applicable liability for defective products, fraud, or other protected consumer claims.

Available remedies and responsibility for loss will be determined under applicable law. You are not required by these terms to waive mandatory statutory remedies.

Disputes and Applicable Law

Please contact us first if you have a concern so we can attempt to resolve it.

These terms do not prevent you from contacting a consumer protection authority, bringing a claim in a court available to you under applicable law, or exercising lawful payment-dispute rights.

Mandatory protections under applicable U.S. federal and state laws and Canadian federal, provincial, and territorial laws remain in effect. Nothing here requires a consumer to surrender protections that apply in their place of residence.

Changes to These Terms

We may update these terms for future use of the store and future orders.

The terms provided when you placed an order govern that purchase, unless a change is required by law or you expressly agree otherwise. An update does not retroactively remove an existing guarantee or remedy.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
